First of I will give my age as 36. when I was in my early twenties I was able to do side and front splits, but got away from training ...life got in the way. I have been training again in Kung fu and have at times got my side split a few inches off the ground, but it has not been consistent. Also my left leg seems to get lower than my right in a side split. any ideas why this is happening.
Also i like to ask if I am recovering from a leg work out and i am on a off day, but want to do relaxed stretches will it hurt my progress if my splits do not get as low as with isometric strecthes. Will it reset my static flexability at this less flexable level?

The different depths of split will depend on the strenth in the legs. It sounds like one leg is in better condition than the other.
If you treat isometric and static passive as different animals and as such doing static passive stretching on a rest day should merely aid recovery.
